Mediation

As a lawyer specializing in workers' compensation, I have represented both employers and employees at different times in my career. I have attended successful mediations many times over the years. In 2007, after many years of seeing the benefits of mediation as an advocate, I decided to become a certified mediator myself. I'm a registered neutral with the Georgia Office of Dispute Resolution, and I'm available to mediate your claim. I will travel to you or we can use my offices in Roswell or Gainesville. My goal is to make the mediation process cost effective and successful.

My experience helps me understand both sides in a workers' compensation claim.   I am able to explain the settlement process to claimants in clear terms and to help them develop realistic expectations.  I am also able to help employers and insurers understand the claimant's point of view in the settlement process, and I have an indepth understanding of how claims are evaluated by insurers.

Fee Structure:

Single mediation: Flat fee of $750.00, split between the parties. No administrative fee, no travel charge.

Two mediations in the same day: $600.00 each.

   Tips for a successful mediation:

• Prepare a short opening  statement describing your side of the claim. 
•  Present the details of the claim without antagonizing the other side.
• Employers/Insurers- Bring  a claims representative to the mediation. The claim is much more likely to settle if an adjuster with authority is present.

• Claimants' attorneys- If your client has an involved spouse, invite the spouse to the mediation. A spouse can often help the injured worker make tough decisions at the mediation.
• Be patient.  Many times an injured worker needs time to adjust to the possibility that his/her claim will not settle for the amount demanded.  Claims involving demands and offers that seem impossibly far apart, often settle if the parties are willing to spend enough time at the mediation.
• Remember that the Claimant may feel that the mediation is his/her "day in court".  Allowing the Claimant to vent  and acknowledging that the Claimant has been through a difficult time can help the Claimant get in the right frame of mind to settle.
• Attend the mediation with the understanding that compromise will be necessary. Avoid putting too much emphasis on your client's "bottom line."  Sometimes the parties are close enought to settle, but the concept of the "bottom line" can get in the way of reaching a resolution.
